What is the Fair Debt Collection Practices Act?
The Fair Debt Collection Practices Act was enacted by Congress to eliminate abusive debt collection practices by debt collectors, to ensure that those debt collectors who refrain from using abusive debt collection practices are not competitively disadvantaged and to promote consistent state action to protect consumers against abusive debt collection practices. The Act expressly prohibits debt collectors from engaging in numerous specific acts or practices and requires debt collectors who attempt to collect consumer debts for others to perform specific acts. The Fair Debt Collection Practices Act allows for statutory damages, actual damages and attorney's fees to be paid to consumers by debt collectors.
