Discrimination Claims

Minneapolis Discrimination Attorneys

Discrimination is a degrading experience no matter where it occurs. Nothing can ever make you feel whole again. However, when it happens, you may be entitled to receive compensation. At the law firm of Scrimshire, Martineau, Gonko & Vavreck in Minneapolis, we offer a free consultation to explain your rights and your options.

Employment discrimination based on race, age, gender, disability, national origin, sexual orientation, or religion is illegal under state and federal civil rights laws. Not all incidents of insensitive and boorish behavior at work rise to the level of an employment discrimination case. Compensable cases often have the following elements in common:

  • The behavior was repeated. One or two incidents may not be enough.
  • The incidents were documented in a journal and by witnesses.
  • The victim notified the employer of the discrimination — and then the behavior happened again.

If you are a victim of discrimination, there are several things you must do to protect your rights. You need to report the discrimination the Equal Employment Opportunity Commission within 300 days of the date it happened. If you receive a right to sue letter from the EEOC, you have 90 days to file a case or the statute of limitations will prevent you from doing so.

If you have a claim under state law, you need to report the discrimination to the Minnesota Department of Human Rights (MDHR) within one year of the date it happened. When you receive a right to sue letter from the MDHR, you have 45 days to file a case or the statute of limitations will prevent you from doing so. It is best to contact a lawyer as soon as possible to ensure you follow all of the proper steps to protect your claim.
